Welcome to Flock. These Terms of Service ("Terms") govern your access to and use of Flock's church group management platform and services. By using Flock, you agree to these Terms.
1. Acceptance of Terms
By creating an account or using Flock, you agree to be bound by these Terms and our Privacy Policy. If you don't agree, please don't use our service.
2. Description of Service
Flock provides a mobile-first platform for church leaders to manage their groups, including:
- Real-time prayer wall and prayer request management
- Attendance tracking and engagement insights
- Event scheduling and RSVP management
- Member communication and notifications
- Pastoral AI intelligence for group health monitoring
3. Account Registration
To use Flock, you must:
- Be at least 18 years old
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
- Be responsible for all activity under your account
4. Acceptable Use
You May:
- Use Flock to manage your church groups and shepherd your people
- Share prayer requests and spiritual content appropriate for a church setting
- Track attendance and engage with your group members
- Invite members to join your groups
You May Not:
- Use Flock for any unlawful purpose or activity
- Share hateful, abusive, threatening, or discriminatory content
- Impersonate others or provide false information
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the service
- Use automated systems to access the service without permission
- Sell, rent, or lease your account
- Remove or modify any proprietary notices
5. Content and Intellectual Property
Your Content
You retain ownership of content you submit (prayers, messages, photos, etc.). By submitting content, you grant Flock a license to store, process, and display that content as necessary to provide our service.
Our Property
Flock and all associated trademarks, logos, and service marks are owned by Covenant Labs LLC. Our platform's design, code, and functionality are protected by intellectual property laws.
6. Privacy and Data Protection
Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy. Key points:
- Your church's data is isolated from other organizations
- Prayer privacy levels are strictly enforced
- We use bank-level security to protect your information
- We never sell your personal data
7. Payment Terms
Some features of Flock may require payment. If you subscribe to a paid plan:
- Payments are processed securely through our payment processor
- Subscriptions automatically renew unless cancelled
- You can cancel anytime; cancellation takes effect at end of billing period
- We may change pricing with 30 days notice to existing subscribers
- Refunds are provided at our discretion on a case-by-case basis
8. Service Availability
We strive to provide reliable service, but we don't guarantee:
- Uninterrupted or error-free operation
- That defects will be corrected immediately
- That the service will meet all your requirements
We may modify, suspend, or discontinue any part of the service at any time with reasonable notice.
9. Termination
By You
You may terminate your account at any time through your account settings or by contacting [email protected].
By Us
We may suspend or terminate your account if:
- You violate these Terms
- Your use poses security or legal risks
- You fail to pay required fees
- We discontinue the service (with reasonable notice)
Effect of Termination
Upon termination:
- Your access to the service ends immediately
- You can export your data within 30 days
- We'll delete your data according to our Privacy Policy
- Certain provisions of these Terms survive termination
10. Disclaimers and Limitation of Liability
Disclaimers
FLOCK IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLOCK TECHNOLOGIES LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR $100, WHICHEVER IS GREATER.
11. Indemnification
You agree to indemnify and hold Covenant Labs LLC harmless from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of the service
- Your violation of these Terms
- Your violation of any rights of another party
- Content you submit to the service
12. Dispute Resolution
If a dispute arises:
- Contact us first at [email protected] to resolve informally
- If informal resolution fails, disputes will be resolved through binding arbitration
- Arbitration will be conducted in accordance with the American Arbitration Association rules
- You waive the right to participate in class actions
13. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict of law provisions. Any legal action must be brought in the courts located in Texas.
14. Changes to Terms
We may modify these Terms at any time. We'll notify you of material changes via email or through the service. Continued use after changes constitutes acceptance of the modified Terms.
15. General Provisions
- Entire Agreement: These Terms constitute the entire agreement between you and Flock
- Severability: If any provision is found unenforceable, the rest remains in effect
- No Waiver: Our failure to enforce any right doesn't waive that right
- Assignment: You may not assign these Terms; we may assign them to affiliates or successors
